Platform-to-Business Regulation Terms
These Platform-to-Business Regulation Terms (“P2B Terms”) apply because FanWear operates as a creator-to-buyer online marketplace, facilitating sales of physical memorabilia from Creators to Buyers.
FanWear is required to provide clear disclosures regarding:
- How creators are ranked
- How content is displayed
- How accounts may be suspended
- How complaints are handled
- What data is accessible to creators
- What contractual relationship exists between Creator and FanWear
These terms are designed to give Creators transparency into how FanWear functions.
1. Identity Of The Platform Operator

2. Main Features Of FanWear’s Marketplace
FanWear provides Creators with:
- A marketplace to list memorabilia, worn items, props, and collectible goods
- Payment processing services via third-party processors such as CCBill
- Product listing capabilities
- Pricing tools
- Shipping coordination (direct-to-Buyer or Creator-to-FanWear logistics)
- A future Creator dashboard for item management
- Customer-service support for Buyers
FanWear does not:
- Provide appraisal or valuation services
- Guarantee Creator sales or earnings
- Guarantee item authenticity beyond Creator representations
- Provide legal advice
- Act as an employer or agent of Creators
3. Ranking And Search Results
FanWear displays Creator Items on the Platform using a combination of:
- Relevance to search terms
- Item category
- Popularity or engagement
- Recency of listing
- Completeness of product information
- Compliance with FanWear guidelines
- Risk or safety factors
- Platform promotions or special features
- Stock availability
Creators cannot pay to increase ranking or placement unless FanWear introduces an optional promotional tool in the future.
FanWear may feature certain Creators or items at its discretion for marketing purposes.
4. Data Access For Creators
Creators may access, depending on available features:
- Their own listing data
- Order information for items they provided
- Shipment tracking (if FanWear manages fulfillment)
- Performance analytics (future functionality)
- Basic sales history
- Buyer anonymized data needed for fulfillment (name, address)
Creators cannot access:
- Buyer payment information
- Other creators’ sales data
- Private FanWear analytics
- Buyer contact details except those necessary to fulfill orders
FanWear retains all platform-level analytics and anonymized data.
5. Restrictions On Platform Use
Creators must comply with all platform rules, including:
- Not selling illegal or unsafe items
- Not misrepresenting the item’s history
- Not engaging in harassment or off-platform solicitation
- Not attempting to circumvent FanWear’s systems
- Not submitting counterfeit or stolen items
- Not violating intellectual property laws
Buyers must similarly follow all usage restrictions described in the Terms of Use and Acceptable Use Policy.
Violations may lead to suspension, withholding payouts, or account termination.
6. Grounds For Suspension, Removal, Or Delisting
FanWear may suspend, delist, restrict, or remove a Creator Item or Creator Account for:
- Fraud
- Counterfeit goods
- Misrepresentation
- Harassment or abusive behavior
- Chargeback abuse
- Non-compliance with any policy
- Risk to Buyers or the platform
- Payment processor compliance issues
- Legal or regulatory requirements
- Failure to provide required identity or payment verification
- Selling prohibited or unsafe goods
- Attempting to circumvent the platform
FanWear will generally notify the Creator unless prevented by law or payment processor rules.
7. Effects Of Suspension Or Termination
Upon suspension or termination:
- Creators may lose access to dashboards or features
- Payments may be withheld pending review
- Listings may be removed
- Pending shipments may be paused
- FanWear may cancel unfulfilled orders
- The Creator may lose eligibility for future participation
FanWear has no obligation to restore suspended accounts.
8. Contractual Relationship Between FanWear And Creators
Creators acknowledge that:
- FanWear is not their employer
- FanWear is not their agent or representative
- Creators operate as independent sellers
- The Sale Contract is strictly between Buyer and Creator
- FanWear provides access to a marketplace and payment infrastructure
- FanWear may require creators to sign additional agreements (e.g., MSA, Creator Agreement)
FanWear retains the right to:
- Adjust payout structures
- Change platform functionality
- Enforce platform rules
- Suspend or remove Creator content
9. Payment Terms And Fees
Creators agree that:
- FanWear deducts platform fees as disclosed during onboarding
- Fees may include:
- Platform fee
- Payment processor fee
- Chargeback fee
- Compliance fee
- Shipping or handling costs
- Payouts are subject to verification and risk controls
- Payment timing may vary
- Chargebacks may be deducted from future earnings
Creators are responsible for all taxes owed in their jurisdiction.
10. Complaints And Dispute Handling
Creators may submit complaints regarding:
- Account actions
- Item removals
- Payout issues
- Listing restrictions
- Ranking problems
- Platform operational errors
Complaints must be submitted to:
creators@fanwear.vip
FanWear commits to responding within a reasonable timeframe consistent with the Complaints Policy in SECTION 6.
11. Termination By FanWear
FanWear may terminate a Creator’s access:
- Immediately, for severe violations
- Without notice, for fraud or counterfeit goods
- With notice, for lesser violations
- In compliance with law enforcement or regulatory requests
FanWear may also permanently ban repeat violators.
12. Termination By Creator
Creators may request account termination by contacting:
creators@fanwear.vip
FanWear may require:
- Outstanding shipments to be resolved
- Outstanding payouts to be held pending review
- Identity verification before final payout
Listings will be removed upon account closure.
13. Transparency Commitments
FanWear commits to:
- Provide Creators with clear listing rules
- Provide transparent fees and payment schedules
- Provide written reasons for major enforcement actions
- Allow Creators to appeal certain decisions (see SECTION 7)
- Maintain fair and non-discriminatory marketplace standards
14. Modifications To These P2B Terms
FanWear may revise these P2B Terms at any time.
Changes will be posted on the Platform. Continued use means acceptance.
