Collector Item Policy

This Collector Item Policy (“Policy”) explains the rules, disclosures, disclaimers, and standards governing the sale of memorabilia, creator-worn goods, novelty items, props, signed items, and other collectible physical products sold through FanWear.

This Policy is legally binding for all Buyers and Creators and is incorporated by reference into the Terms of Use, Contract Between Buyer and Creator, and all other FanWear policies.

1. Purpose Of This Policy

The purpose of this Policy is to:

  • Clarify the nature and limitations of collector items sold on FanWear
  • Protect Creators and Buyers from misunderstandings
  • Establish authenticity and provenance expectations
  • Set clear standards for listing accuracy
  • Disclose all risks involved in purchasing memorabilia
  • Define Creator responsibilities
  • Define Buyer responsibilities
  • Limit platform liability in accordance with Texas law

This Policy applies to all items sold on FanWear.

2. Nature Of Collector Items

FanWear sells physical memorabilia, including but not limited to:

  • Creator-worn clothing
  • Props used or possessed by creators
  • Signed items
  • Vintage apparel
  • Limited-edition merchandise
  • Items used in creator content
  • Novelty items or themed memorabilia
  • Collector goods not intended for functional use

Collector items may display:

  • Wear and tear
  • Residue or markings
  • Signs of use
  • Fading
  • Creasing
  • Fabric stretching
  • Scent or odor associated with wear
  • Creator personalization (signatures, notes, doodles)

These characteristics are expected and considered part of the item’s value.

3. Items Sold “As-Is”

All collector items sold on FanWear are sold strictly as-is, including:

  • Condition
  • Wear level
  • Scent or lack thereof
  • Material variations
  • Authenticity markings
  • Any imperfections
  • Packaging condition

Buyers agree that:

  • They have read and understood the listing description
  • The item’s condition may vary from expectations
  • Wear levels can differ from item to item
  • No refunds, returns, or exchanges apply

4. Intended Use

Collector items sold on FanWear are meant for:

  • Display
  • Collection
  • Memorabilia preservation
  • Personal enjoyment
  • Investment (at buyer’s discretion)

Collector items are not intended for:

  • Practical clothing use
  • Repetitive wear
  • Intimate use
  • Athletic or performance use
  • Scenarios requiring hygienic certification

Buyers agree to use items at their own risk.

5. Authenticity And Provenance

FanWear does not guarantee item authenticity beyond Creator representations.

Creators are solely responsible for:

  • Provenance claims
  • Wear claims (“worn during X event/video”)
  • Signature authenticity
  • Ownership legitimacy
  • Any descriptive statements about the item

Buyer acknowledges that:

  • All authenticity claims originate from the Creator
  • FanWear does not independently verify authenticity
  • FanWear does not certify signatures
  • FanWear does not certify wear or usage
  • FanWear does not perform lab or forensic testing
  • FanWear is not liable for inaccurate descriptions

Creators must indemnify FanWear for misleading or fraudulent claims.

6. Hygiene And Safety Disclosure

Collector items — especially worn apparel — may carry:

  • Skin contact traces
  • Fabric oils
  • Scent or deodorant remnants
  • Makeup transfer
  • Fragrance
  • Wear-related debris
  • Laundry detergent residue
  • Environmental particulates

FanWear provides no guarantees that items are:

  • Sanitized
  • Allergen-free
  • Free of irritants
  • Free of fragrances
  • Suitable for sensitive skin
  • Safe for intimate contact
  • Safe for wear

Buyers with allergies or sensitivities purchase at their own risk.

7. Creator Responsibilities

Creators must:

  • Describe items truthfully
  • Disclose major defects
  • Represent provenance honestly
  • Ensure they own the item legally
  • Avoid counterfeit merchandise
  • Ship the correct item
  • Ship items in acceptable condition
  • Comply with all FanWear policies

Creators may not:

  • Misrepresent an item’s uniqueness
  • Oversell authenticity
  • Submit stolen goods
  • Submit replicas or fakes labeled as originals
  • Conceal significant flaws or damage
  • Alter an item to create misleading wear

Creators violating this Policy may face:

  • Payout holds
  • Account suspension
  • Permanent bans
  • Legal action
  • Liability toward FanWear

8. Buyer Responsibilities

Buyers must:

  • Review all descriptions carefully
  • Understand the nature of collector items
  • Accept that imperfections are normal
  • Use purchased items responsibly
  • Not file fraudulent disputes
  • Not attempt to demand refunds for subjective reasons

Buyers acknowledge that:

  • All sales are final
  • Items may differ slightly from photos due to lighting or display differences
  • Size, material feel, or wear perception may vary

9. Photos, Videos, And Representations

Creators must upload:

  • Accurate item photos
  • Honest depictions of condition
  • Content that reflects real item state

Buyers acknowledge that:

  • Colors appear differently across screens
  • Lighting, cameras, and filters affect appearance
  • Minor discoloration or imperfections may not be visible in photos
  • Items may appear slightly different in person

FanWear may remove listings that misrepresent items.

10. Restricted Items

Creators may not sell:

  • Illegal goods
  • Weapons (unless legally compliant and pre-approved by FanWear)
  • Items containing bodily fluids
  • Counterfeit branded apparel
  • Dangerous goods
  • Hazardous materials
  • Items prohibited by payment processors
  • Items violating copyright or trademark law

FanWear reserves the right to reject any item.

11. Shipping And Risk Disclosure

Once a carrier accepts the package:

  • Risk transfers to the Buyer
  • FanWear is not responsible for carrier loss or damage
  • FanWear is not responsible for customs delays
  • FanWear is not responsible for stolen packages

Insurance may not apply unless expressly stated.

12. No Returns, Refunds, Or Exchanges

Due to the unique nature of collector items:

  • All sales are non-refundable
  • All sales are final
  • No returns or exchanges are accepted

Buyers agree to this policy at checkout.

13. Disputes Regarding Item Condition

FanWear may deny condition-based disputes if:

  • Wear is consistent with a used or worn item
  • Condition is reasonably depicted in photos
  • Imperfections described in the listing are present
  • The Buyer’s expectations exceed the description
  • The Buyer misunderstood wear levels
  • The Buyer attempts to misuse policy protections

Creators must cooperate in any condition review.

14. Indemnification

Creators agree to indemnify FanWear for:

  • Misrepresentation
  • Counterfeit goods
  • Stolen items
  • Trademark infringement
  • Unsafe items
  • Buyer claims arising from inaccuracies

Buyers agree to indemnify FanWear for:

  • Fraudulent disputes
  • Misuse of items
  • Violations of this Policy
  • Attempts to circumvent platform rules

15. Liability Limitations

FanWear is not liable for:

  • Wear-related dissatisfaction
  • Differences in perception of condition
  • Allergic reactions
  • Odor or scent presence
  • Material sensitivity
  • Damage after delivery
  • Collector value depreciation
  • Disputed authenticity
  • Post-sale degradation

Our maximum liability is USD $250, or a the purchase price, whichever is greater.

16. Updates To This Policy

FanWear may update this Policy at any time.
Continued use of FanWear means acceptance of updates.
