This Appeals Policy (“Policy”) provides Users with a formal method to challenge major enforcement decisions, including account termination, permanent bans, severe listing restrictions, or major payout holds.

It exists to ensure fairness, transparency, and due process while protecting platform integrity.

1. Purpose Of The Appeals Policy

This Policy is intended to:

  • Provide a structured appeals process
  • Allow Users to contest significant enforcement actions
  • Ensure that serious decisions receive a second-level review
  • Maintain compliance with online marketplace best practices
  • Offer Creators and Buyers a fair opportunity to respond to evidence

This Policy applies only to actions listed in Section 2.

2. Decisions Eligible For Appeal

The following actions may be appealed:

  • Permanent account bans
  • Permanent suspension of Creator Accounts
  • Removal of all Creator listings
  • Long-term payout holds
  • High-impact enforcement decisions affecting earnings
  • Denial of Creator onboarding (in specific circumstances)
  • Serious allegations resulting in restrictive measures

Less severe decisions (e.g., temporary suspensions, listing edits, or minor content removals) must be handled through the Complaints Policy rather than this Appeals Policy.

3. Decisions Not Eligible For Appeal

The following cannot be appealed:

  • Actions required by law enforcement
  • Payment processor-mandated freezes
  • Fraud findings supported by conclusive evidence
  • Chargeback results determined by the payment processor
  • Actions taken to comply with safety or legal obligations
  • Repeated violations previously adjudicated
  • Abuse of the complaints or appeals systems
  • Actions taken to prevent harm, risk, or illegal activity

FanWear also reserves the right to deny an appeal if:

  • Evidence strongly indicates fraud
  • The User poses an ongoing risk
  • The User is already permanently banned for severe behavior

4. How To Submit An Appeal

Submit appeals to:

support@fanwear.vip — for Buyers
creators@fanwear.vip — for Creators

Your appeal must include:

  • Full name
  • Account email
  • A detailed explanation of why you believe the decision was incorrect
  • All relevant order IDs, listing IDs, or case numbers
  • Evidence supporting your position (screenshots, receipts, tracking, etc.)

Appeals lacking sufficient information may be rejected.

5. Evidence Requirements

Depending on the violation, Users may be required to submit:

  • Government-issued ID
  • Item ownership proof (Creators)
  • Product photos or metadata
  • Bank or payment verification
  • Emails from carriers
  • Screenshots or logs
  • Contracts or written communications
  • Any and all documents needed to confirm legitimacy

Failure to provide evidence may result in automatic denial.

6. Review Process

FanWear will:

  • Acknowledge receipt of the appeal
  • Review the initial enforcement action
  • Reevaluate evidence from both sides
  • Request additional information if necessary
  • Consult internal logs, staff, and moderation notes
  • Make a final determination based on all information

FanWear conducts appeals using:

  • A case-by-case analysis
  • Neutral internal review
  • Risk and safety considerations
  • Compliance obligations

7. Response Timeframe

FanWear aims to:

  • Review appeals within 10–20 business days
  • Respond sooner for lower-complexity cases
  • Extend timelines for:
    • Payment processor involvement
    • High-risk investigations
    • Legal requests
    • Cross-border issues

Timeframes are not guaranteed but efforts will be made to respond promptly.

8. Possible Outcomes

Possible appeal outcomes include:

  • Reinstatement of an account
  • Restoration of listings
  • Release of payouts (if verification and risk checks allow it)
  • Modification of the enforcement action
  • Confirmation that the original action was correct
  • Permanent termination (upheld)
  • Escalation to specialized review teams

FanWear’s decision after appeal review is final.

9. False Or Fraudulent Appeals

FanWear may deny appeals if:

  • Evidence is falsified
  • The appeal includes misleading or dishonest information
  • The User attempts to manipulate the process
  • Abuse of the appeals system is detected

Consequences may include:

  • Permanent ban
  • Loss of payouts
  • Reporting to law enforcement
  • Liability under applicable laws

10. Multiple Appeals

Users may only submit:

  • One appeal per enforcement action, unless FanWear explicitly requests more information.
  • Duplicate or repetitive appeals will be rejected.

FanWear may block further submissions for Users abusing the process.

11. Relationship With Other Policies

This Appeals Policy works alongside:

  • The Terms of Use
  • The Acceptable Use Policy
  • The Contract Between Buyer and Creator
  • The Complaints Policy
  • The Privacy Policy
  • The Collector Item Policy
  • The Community Guidelines

If a conflict exists, the Terms of Use govern.

12. No Guarantee Of Reversal

Submitting an appeal does not guarantee:

  • Account reinstatement
  • Payout release
  • Listing restoration
  • Favorable outcomes

FanWear’s priority is platform safety, compliance, and integrity.

13. Updates To This Policy

FanWear may update this Policy at any time.
Continued use of the Platform indicates acceptance of updates.
