These Affiliate Terms (“Terms”) govern participation in the FanWear Affiliate and Referral Program (“Program”). By applying to or participating in the Program, you agree to these Terms and FanWear’s general Terms of Service.

1. Definitions

For purposes of these Terms:

Affiliate
A user approved by FanWear to promote the platform using a referral link or code.

Referred Creator
A Creator who joins FanWear using an Affiliate’s referral link or code.

Referral Reward
A commission, payout, credit, or other incentive granted by FanWear.

Referral Link or Code
The unique tracking link or code issued by FanWear to an Affiliate.

Referral Period
The time period during which an Affiliate is eligible to earn rewards from a referred Creator.

2. Eligibility

To participate in the Program, Affiliates must:

•  Be at least 18 years old
•  Provide accurate registration information
•  Maintain an active FanWear account
•  Comply with FanWear policies and applicable laws

FanWear may approve or reject Affiliate applications at its discretion.

3. Independent Relationship

Affiliates participate in the Program as independent participants.

Nothing in these Terms creates any partnership, joint venture, employment relationship, or agency relationship between FanWear and the Affiliate.

Affiliates may not represent themselves as employees, agents, or representatives of FanWear.

4. Referral Rewards

FanWear may offer Affiliates referral commissions or other incentives for referring Creators to the platform.

Unless otherwise specified, referral commissions are calculated as a percentage of FanWear’s net earnings from a Creator’s drop.

Net earnings may exclude:

•  payment processor fees
•  refunds
•  chargebacks
•  taxes
•  compliance holds
•  operational deductions

FanWear determines the calculation of referral rewards.

5. Limited-Time Promotions

FanWear may offer temporary promotional referral incentives, including increased commission percentages or extended referral periods.

FanWear may modify or discontinue promotional offers at any time.

6. Referral Attribution

FanWear’s internal tracking systems determine referral attribution and reward eligibility.

FanWear’s determination regarding referral attribution is final.

FanWear is not responsible for tracking failures caused by:

•  ad blockers
•  browser privacy settings
•  link modification
•  third-party interference

7. Affiliate-Creator Relationship Disclosure

Affiliates may not refer Creators with whom they have an undisclosed financial relationship for the purpose of generating referral rewards.

FanWear may require disclosure of any management, ownership, or financial relationship between an Affiliate and a referred Creator.

FanWear may deny, adjust, or revoke referral rewards where such relationships are identified.

8. Marketing and Promotion Rules

Affiliates may not:

•  make false or misleading statements about FanWear
•  guarantee income or financial success
•  misrepresent Creator earnings potential
•  promote FanWear using spam or mass unsolicited messaging
•  use paid advertising without approval
•  misrepresent FanWear’s services or policies

FanWear may require removal of promotional content that violates these guidelines.

9. Affiliate Disclosure Requirements

Affiliates must disclose their referral relationship with FanWear when promoting referral links or codes.

Disclosures must comply with applicable advertising laws, including FTC endorsement guidelines.

Examples may include:

“FanWear Affiliate”
“Referral Link”
“Affiliate Partner”

Failure to disclose affiliate relationships may result in removal from the Program.

10. Brand Representation

Affiliates may not use FanWear branding, trademarks, or promotional materials in a way that implies official partnership or endorsement unless authorized by FanWear.

Affiliates may not publish misleading, defamatory, or harmful statements about FanWear or its Creators.

FanWear may require removal of content that violates these guidelines.

11. Fraud and Abuse

Affiliates may not:

•  create multiple accounts for self-referral
•  refer themselves or entities they control
•  manipulate referral tracking systems
•  generate fake accounts or fraudulent traffic

FanWear may investigate suspicious activity and suspend rewards during investigations.

Violations may result in:

•  loss of rewards
•  removal from the Program
•  account suspension or termination
•  legal action

12. Payments

Referral rewards may be paid through methods determined by FanWear.

FanWear may:

•  set minimum payout thresholds
•  delay payments for verification
•  withhold rewards during investigations
•  deduct refunds or chargebacks

Affiliates are responsible for paying any applicable taxes on referral rewards.

13. Termination

FanWear may terminate Affiliate participation for reasons including:

•  policy violations
•  fraud or suspicious activity
•  misuse of referral links
•  harassment or misconduct

If an Affiliate account is terminated, unpaid rewards may be forfeited.

14. Modification or Discontinuation

FanWear may modify, suspend, or discontinue the Affiliate Program at any time.

FanWear may update these Terms without prior notice.

Continued participation in the Program constitutes acceptance of updated Terms.

15. No Guarantee of Earnings

FanWear does not guarantee:

•  that referrals will join the platform
•  that Creators will generate revenue
•  that referral rewards will be substantial
•  that the Program will remain active

Participation in the Program is voluntary.
