Acceptable Use Policy

This Acceptable Use Policy (“AUP”) forms part of the Terms of Use and applies to all Users of FanWear. The goal is to protect Creators, Buyers, FanWear, and the integrity of the memorabilia marketplace.

1. General Principles

All Users must:

  • Use FanWear lawfully
  • Respect Creators and their privacy
  • Follow all policies linked in the Terms of Use
  • Provide accurate information
  • Avoid conduct that harms FanWear, other Users, or the platform

Any behavior violating these principles may result in account suspension or termination.

2. Prohibited Conduct

Users may not:

  • Use FanWear for illegal or fraudulent purposes
  • Violate any applicable laws or regulations
  • Engage in harassment, stalking, or abuse of Creators or FanWear staff
  • Attempt to bypass or manipulate platform systems
  • Interfere with or disrupt site operations
  • Scrape, harvest, or collect data from FanWear
  • Access any area of the Platform without authorization
  • Upload or post misleading, deceptive, or harmful information

FanWear maintains discretion to determine prohibited conduct.

3. Misuse Of Creator-Related Content

Users may not:

  • Reupload, reproduce, or redistribute Creator images or product photos
  • Share Creator content outside the Platform without written permission
  • Use Creator likenesses to mislead or impersonate
  • Contact Creators outside approved methods
  • Attempt to identify or dox Creators
  • Use purchased items to create false claims or misrepresent resale condition

Creators’ privacy and safety are strictly enforced.

4. Prohibited Transactions

The following are not allowed on FanWear:

  • The sale of illegal goods
  • The sale of stolen items
  • The sale of hazardous materials
  • The sale of counterfeit items
  • Attempts to defraud the payment processor
  • Chargeback abuse
  • Money laundering or payment routing

FanWear cooperates with law enforcement when necessary.

5. Security Violations

Users must not:

  • Attempt to hack, probe, or test vulnerabilities
  • Introduce malware, viruses, or malicious scripts
  • Circumvent security measures
  • Access or use another User’s account without permission
  • Attempt to intercept communications or data
  • Use automated tools, bots, or scraping systems

FanWear continually monitors for abusive or suspicious activity.

6. Creator Obligations

Creators must:

  • Provide truthful information about items
  • Accurately describe condition and authenticity
  • Ensure items are legally owned
  • Avoid uploading infringing materials
  • Use Creator Accounts responsibly when available

Creators may not:

  • Misrepresent worn items as new
  • Make false provenance claims
  • Sell items that could endanger Buyers
  • Upload unauthorized copyrighted materials

Creators are legally responsible for their item descriptions.

7. Buyer Obligations

Buyers must:

  • Provide valid payment and shipping information
  • Not engage in harassment or unwanted contact with Creators
  • Not misuse purchased items for misleading resale
  • Not file fraudulent chargebacks
  • Comply with all payment processor rules

Buyers agree not to circumvent FanWear’s platform or policies.

8. Privacy And Personal Data Misuse

The following are prohibited:

  • Attempting to access private Creator information
  • Attempting to gather or reconstruct a Creator’s identity
  • Sharing someone else’s personal data without consent
  • Posting personal information publicly (“doxing”)
  • Using FanWear data for stalking, harassment, or intimidation

Violations result in immediate account termination.

9. Intellectual Property Restrictions

Users may not:

  • Reproduce or redistribute FanWear-owned media
  • Copy or duplicate product descriptions
  • Use FanWear logos, branding, or trademarks
  • Upload infringing materials
  • Use platform content for competing services

All intellectual property rights are reserved by FanWear.

10. Platform Abuse

Users may not:

  • Manipulate search results
  • Post fake listings or fraudulent data
  • Attempt to manipulate shipping systems
  • Exploit refund or chargeback processes
  • Run unauthorized promotions or advertising
  • Misuse referral systems (present or future)

FanWear may remove content or restrict access at its discretion.

11. Enforcement Actions

FanWear may take any of the following actions:

  • Remove content
  • Temporarily suspend accounts
  • Permanently terminate accounts
  • Withhold order fulfillment
  • Block shipping until verification
  • Freeze account features
  • Deny future access
  • Involve law enforcement if required

FanWear determines enforcement severity based on risk and violation.

12. Reporting Violations

Users may report violations to:

support@fanwear.vip

FanWear investigates reports in accordance with the Complaints Policy.
